BREAKING: Congressman Eric Swalwell throws down the gauntlet to Kristi Noem and Tom Homan and warns them that they’re not “invincible” because the midterm elections are coming — and they’re going to be investigated.
Once Democrats seize control of Congress, it’s game over for MAGA fascism…
“Kristi Noem and Tom Homan, you should familiarize yourself with the four corners of this room,” said Swalwell. “Kristi Noem and Tom Homan, get to know that witness chair. You’re going to be parked in it for a long time.”
“You’re going to have a lot of questions under oath with the subpoena power and I hope what you’re doing is clean and can withstand the scrutiny that everyone on this side of the aisle is going to bring,” he continued. You think we won’t do it. You think you’re invincible. You’re wrong. Accountability is coming. You’ve got about a year and I yield back.”
Swalwell’s threat isn’t just empty bluster. Once we win the House back next November — an increasingly likely scenario given Trump’s worsening economy and Epstein scandal — Democrats will be able to haul anyone they want in front of Congress to testify under oath. Every abuse and corrupt act undertaken by ICE will be placed under a microscope and prosecuted accordingly.
On top of that, Noem and Homan have personal corruption issues to worry about. With subpoena power, Democrats will be able to dig into the $50,000 cash bribe that Homan was caught accepting in a bag in an FBI sting. They’ll also want to probe the fact that a firm timed to Noem secretly received money from $220 million Homeland Security ad contracts.
The most blatantly criminal administration in American history is about to pay the piper.

In a bold escalation of his rhetoric, Democratic Rep. Eric Swalwell (D-CA) recently issued a blistering warning to Kristi Noem and Tom Homan, two prominent figures in homeland security under the Trump-aligned administration. Swalwell declared that they are not invincible — and that, following the next midterm elections, they will face serious oversight and investigation.
Swalwell’s Warning
Appearing on MSNBC’s “The Weeknight”, Swalwell expressed intense confidence that Democrats will reclaim the House majority in the 2026 midterms — and when they do, he says, they plan to wield subpoena power aggressively. Breitbart+1
“These guys think… they’re invincible and there are no consequences,” he said. Breitbart
“A year from now we are going to win the majority … we will have subpoena power and accountability will happen.” Breitbart
Swalwell didn’t limit his criticism to low-level actors. He called out “lawless officials … carrying out these political prosecutions” — a clear allusion to Noem, Homan, and other Trump-connected figures. Breitbart
He went on to say they should “get familiar” with the House Judiciary Committee’s witness chair — suggesting that they will be testifying under oath and facing tough questions. The Daily Beast+1
Why Swalwell Is Targeting Noem & Homan
Swalwell’s warning comes against a backdrop of aggressive immigration enforcement, border crackdowns, and sweeping authority granted to Noem and Homan. His comments reflect a broader strategy — positioning Democrats to hold officials accountable once they have the power to investigate.
Some of the key aspects motivating this push:
- Immigration Tactics & Enforcement
Noem, serving in a top homeland security role, and Homan, as a border czar, have been central to hardline immigration policies. Critics like Swalwell argue their methods, and perhaps some of their decision-making, warrant a full congressional look. - Perceived Lawlessness
Swalwell frames his anticipated investigations not merely as partisan score-settling but as a defense of the rule of law: “accountability” for decisions made with serious consequences. Breitbart+1 - Electoral Leverage
By tying his threats to the midterm elections, Swalwell is sending a dual message: to his political base (mobilize) and to Noem and Homan (prepare for scrutiny).
Reactions & Risks
- Supporters of Swalwell applaud the move as a firm stand for oversight and democratic accountability. They see it as long overdue after years of controversial enforcement policies.
- Critics, however, warn this could be politically motivated. Some may portray it as a “witch-hunt” once Democrats regain power — potentially undermining the legitimacy of any probe if it is perceived as partisan vengeance.
There’s also risk for Swalwell himself: by publicly declaring his intent, he raises expectations. If investigations don’t lead to concrete revelations (or if they backfire), his credibility could suffer.
What This Means Going Forward
If Swalwell’s prediction comes true and Democrats retake the House, his pledge could be more than rhetoric. Subpoena power could open up real investigations into:
- Noem and Homan’s decision-making and communications
- Financial dealings and contracts tied to border enforcement
- Internal DHS processes and how immigration operations are run
Whether or not these investigations happen — and how far they go — will depend heavily on the political balance after the 2026 midterms. But for now, Swalwell’s message is clear: he believes his opponents are not beyond consequence.
